What these terms cover

These terms apply to visiting and using this site: the practice-area pages, the articles in the legal blog, the lawyer profiles and the contact form.

They do not cover legal services themselves. Assistance and representation arise from a written legal services agreement, which has its own clauses. Where that agreement says something different from this page, the agreement prevails.

By using the site you accept what follows. If you do not, please do not use it.

The information on this site is not legal advice

This is the most important statement on the page, so we will put it plainly.

The practice-area pages and the blog articles explain general rules. They were written at a given moment, for a reader we do not know, and without any knowledge of your situation. They are not a legal opinion and they are no substitute for one.

The law changes, and the same rule produces different outcomes depending on the facts and the documents behind them. An article on insolvency proceedings will not tell you what to do in your own case; at best it shows you what to look at.

Do not make a decision — and above all, do not let a deadline run — on the strength of what you read here alone. Ask a lawyer, whether us or anyone else, and give them the full facts.

We do our best to keep these texts current, but we cannot guarantee that every page reflects the law as it stands today. Each article carries its publication date, precisely so that you can judge how fresh it is.

A message sent through the site does not create a lawyer-client relationship

The contact form is a way of getting in touch with us, nothing more.

Until we conclude a legal services agreement, we are not your lawyers: we are under no obligation to act, to watch deadlines or to take any step in your matter. A message read is not a mandate accepted.

Before taking on a matter we check whether we are in a conflict of interest. It may turn out that we cannot accept your case even though you contacted us first, and in that event we will tell you so without explaining why — professional secrecy stops us there as well.

For that reason, please do not send us documents, the full details of your case, health data, information about criminal offences or other sensitive data through the form. What you write to us is covered by professional secrecy in any event, under Law no. 51/1995 and the Statute of the profession — but the right channel for a case file is something we will agree on together, once we have spoken.

What you may do with the content of this site

The texts, the articles, the photographs, the logo, and the selection and arrangement of all of these on the page are protected under Law no. 8/1996 on copyright and related rights.

You may, without asking us:

  • read, print and save the pages for your own use;
  • quote a short passage from an article, naming the author and linking to the page you took it from, within the limits the law allows;
  • send someone else the address of a page.

You may not, without our written consent:

  • republish a whole article, or a substantial part of one, on any medium;
  • use the texts for commercial purposes, including to train an automated system;
  • use the logo, the name of the law office or the names of the lawyers in a way that would lead anyone to believe that we are associated with you or that we have endorsed what you do.

How we ask you to use the site

Please do not:

  • attempt to gain access to the administration area or to anyone else’s data;
  • send automated messages, advertising or content unrelated to our work through the form;
  • copy the content systematically, by program, at a rate that loads the server;
  • attempt, by any means, to make the site unavailable to others.

The form limits in any case how many messages can be sent in a short interval. We may restrict access from wherever such requests originate.

Links to other sites

Some pages link to sites we do not run: legislative texts, pages of public authorities, specialist publications. We include them because they were useful at the time of writing.

We are not responsible for what is there, nor for what changes afterwards. A link does not mean we agree with everything that site publishes.

Availability of the site

We would like the site to be available at all times, but we do not promise that it will run without interruption. We take it down for updates now and then, and services it depends on sometimes fail.

We may change, move or withdraw any page at any time. We keep the addresses of published articles wherever we can, so that old links still lead where they used to.

The limits of our liability

The site is made available to you as it is. We are not liable for losses arising from the use of the general information here without having asked us about your own matter.

That limitation concerns the site, not our work as lawyers. Professional liability is an entirely different thing: it is governed by law, covered by compulsory professional indemnity insurance, and what we undertake in a given case is set out in the legal services agreement.

Nothing in these terms removes or limits a liability that the law does not permit us to remove.

Your personal data

What happens to the data you send us through the form is set out at length in the Privacy policy, which you will find in the footer of every page.

In short: we use it to reply to you; the site sets no cookies for visitors, has no traffic measurement tools, and loads nothing from foreign servers.

Governing law and settlement of disputes

These terms are governed by Romanian law.

If a dispute arises, please write to us first — most of the time a conversation settles the matter. Failing agreement, the courts of Bucharest have jurisdiction.

If you use the site as a consumer, the above does not deprive you of the protections afforded by the law of the country where you live, and you may bring proceedings before the courts there, in accordance with the European regulations on the law applicable to contractual obligations and on jurisdiction.

Complaints concerning a lawyer’s professional conduct may also be addressed to the Bucharest Bar Association, which supervises the practice of the profession.

Changes to these terms

The date from which the version you are reading applies is shown at the top of the page. When we change something, we publish the new version here, with its own date.

We keep earlier versions, so that we can show what the terms said at any given moment.
